The Alarm Nobody Ever Tested: What OSHA 1910.165 Actually Requires
OSHA 1910.165 governs how your crew learns to evacuate. Learn the two-month testing rule, the ambient noise standard, and the small-employer exception.
Most small employers can point to the fire alarm pull station by the back door. Far fewer can say when anyone last pulled it on purpose. That gap — between having an alarm and having a working, tested, understood alarm — is what 29 CFR 1910.165 exists to close, and it is one of the quieter ways a routine inspection turns into a citation.
The standard is short, which is part of why it goes unread. It also costs almost nothing to satisfy. The equipment is usually already on the wall. What is missing is the schedule, the log, and twenty minutes of thought about whether the signal would actually reach the person running the saw in the back bay.
Where the requirement comes from
Section 1910.165 does not stand alone. It applies to any emergency employee alarm installed to meet another OSHA standard, and the most common trigger is 1910.38, the emergency action plan rule. Most employers have an EAP, because 1910.157(a) requires one whenever your fire policy is total evacuation rather than employee firefighting. Once you have one, 1910.38(d) obligates you to have and maintain an employee alarm system that complies with 1910.165, using a distinctive signal for each purpose — which matters more than it sounds in a building where the same bell means shift change, delivery, and fire.
Construction works from a parallel provision: 1926.150(e) requires a fire alarm system with a conspicuously posted alarm code and reporting instructions, and 1926.35 carries the emergency action plan obligation.
The ambient noise problem
Subsection (b)(2) is where good-faith employers fail. The alarm must be capable of being perceived above ambient noise or light levels by all employees in the affected portions of the workplace. Not audible in the front office where the panel lives — perceptible everywhere people work.
This is a practical test, not a paper one. If the grinder and the dust collector together push past 90 decibels, a bell sized for a retail storefront will not carry, and hearing protection narrows the margin further. The standard anticipates this and permits tactile devices for employees who would not otherwise recognize an audible or visual alarm — also the accommodation route for employees who are deaf or hard of hearing. Strobes are the usual answer in high-noise areas, though a strobe only helps if it is in the person's line of sight, not behind a stack of pallets.
Subsection (b)(3) adds that the alarm must be distinctive and recognizable as a signal to evacuate or to take the action assigned in the plan. Employees who cannot distinguish the evacuation tone from the microwave do not have an alarm. They have a noise.
Testing every two months, and the rotation rule
The requirement that catches most employers is subsection (d)(2): a test of the reliability and adequacy of non-supervised employee alarm systems must be made every two months. Six tests a year, applied to the typical unmonitored horn-and-pull-station setup found in small shops.
The wrinkle is the second sentence. A different actuation device must be used in each test of a multi-actuation device system, so no individual device is used for two consecutive tests. If you have four pull stations, you rotate through them. Pulling the same convenient one by the office door six times a year satisfies the count, violates the rule, and defeats the purpose — the point is discovering that the warehouse station has a dead circuit before you need it.
Supervised systems — circuitry that self-monitors and reports trouble — get a lighter schedule of annual testing under (d)(4). Almost any modern monitored fire alarm panel installed by a licensed vendor falls here, and your vendor's annual inspection report is your documentation. Keep it.
Under (d)(1) and (d)(3), the system must also stay in operating condition with power supplies maintained or replaced as needed. When it is out of service, you must provide a backup means of alarm, which the standard explicitly allows to be employee runners or telephones. That is your cover during a panel replacement, provided you actually assign someone.
The small-employer exception people misread
Subsection (b)(5) permits employers with 10 or fewer employees in a particular workplace to sound the alarm by direct voice communication, provided all employees can hear it, and those workplaces need not have a backup system. It is a real and useful exception, but note what it does not say. It counts employees at that workplace, not company-wide. It requires that everyone can actually hear a shouted warning, which fails the moment someone is on a roof or in a walk-in cooler. And it does not exempt you from the rest of the section, including the (b)(4) obligation to explain the preferred means of reporting an emergency and to post emergency numbers.
What to do this week
Walk the floor during your loudest hour and have someone sound the alarm while you stand at the farthest work position. If you cannot hear or see it, you have found your finding before OSHA did. Then start a simple log — date, device actuated, who tested, whether it worked — and set a recurring reminder at eight-week intervals. Under (e)(1), confirm every manual pull station is unobstructed, conspicuous, and readily accessible, which in practice means moving whatever got stacked in front of the one in the stockroom.
None of this costs money. All of it is the difference between a system that exists and a system that works.
