The small-farm exemption is narrower than it sounds

Agriculture is governed by its own part, 29 CFR 1928, and a long-standing appropriations rider limits OSHA enforcement against small farms that do not operate a temporary labor camp. That is not a general exemption from OSHA. It does not cover every farm, it does not follow you into a labor camp, and it does not switch off the general industry standards that reach farm operations anyway. Check where your operation actually falls before assuming it applies to you.

    Roll-over protective structures and seat belts on tractors, plus the operating practices that go with them. Overturns remain the single largest cause of death on farms.

A program that survives the crew changing twice a year

A factory trains a stable workforce once. A farm trains a new crew every season, often in a second language, often on equipment those workers have never operated. The program that works here is one where induction is quick, records are attached to the person rather than the season, and the same content comes back out next spring without being rebuilt.

Questions we hear

Does the small-farm exemption mean OSHA does not apply to us?

No. The appropriations rider limits enforcement in specific circumstances β€” it is not a blanket exemption, and it does not apply to farms operating a temporary labor camp. General industry standards can still reach farm operations. Confirm where your operation falls rather than assuming.

Do we have to train seasonal workers who are only here six weeks?

Training obligations attach to the hazards a worker is exposed to, not to how long they stay. A worker operating equipment or handling chemicals in week one needs the training in week one.

Who is responsible when we use a labor contractor?

Both employers can carry duties. The contractor employs the workers, but the farm controls the worksite and the equipment. Agree in writing who trains, who supplies PPE and who records injuries before the crew arrives.

Is a grain bin a confined space?

Bins are treated as confined spaces and the grain handling standard sets specific entry conditions, including a permit, body harness with lifeline, and an observer positioned outside. Do not treat bin entry as routine work.

Do we record an injury to a family member?

Recordability depends on employment status and the recordkeeping rules in 29 CFR 1904, not on the family relationship. Establish whether the person is an employee for these purposes before deciding.
