Working Near Overhead Power Lines: What OSHA Expects From Small Contractors

Overhead power line contact kills dozens of workers a year. Here is how small contractors meet OSHA 1926.1408 and 1910.333 clearance rules on real job sites.

There is a particular kind of job site accident that almost never involves a mistake anyone would call reckless. A crew is setting a ladder against a gutter. A dump truck driver raises the bed to clear the last of the gravel. A landscaper extends a pole saw to reach a limb. Nobody is horsing around, nobody skipped a step in a written procedure, and in about a second and a half somebody is dead. Overhead power line contact remains one of the leading causes of electrocution fatalities in construction, and it disproportionately kills people working for companies with fewer than twenty employees — roofers, tree crews, sign installers, HVAC techs, painters, and the general contractors who hired them.

The reason small employers get hit hardest is not that their people are less careful. It is that the controls OSHA expects are planning controls, and planning is the first thing squeezed when the owner is also the estimator and the foreman. The good news is that the core requirements are short, concrete, and nearly free once you build them into how you bid and stage work.

The Distances You Actually Have to Know

OSHA's rules live in two places depending on what you are doing. For cranes and derricks in construction, 29 CFR 1926.1407 through 1926.1411 govern assembly, operation near lines, and travel. For everything else on a construction site — ladders, scaffolds, hand tools, materials being carried — 29 CFR 1926.416(a)(1) prohibits work in a location where an employee could contact an energized line unless the line is deenergized and grounded or otherwise guarded by effective insulation. In general industry, 29 CFR 1910.333(c)(3) covers unqualified persons and sets the same basic idea: stay ten feet away from anything up to 50 kV, and add four inches for every additional 10 kV.

Ten feet is the number to teach. Under 1926.1408, if the crane's boom, load line, or load could get within twenty feet of a line up to 350 kV, you must pick one of three options: deenergize and visibly ground the line, keep twenty feet of clearance, or determine the line's actual voltage and use the corresponding table clearance, which for lines up to 50 kV is ten feet. Most small contractors will never negotiate a utility shutdown, so the practical answer is the twenty-foot rule for crane work and the ten-foot rule for everything else. If a worker is holding anything conductive — an aluminum ladder, a metal gutter section, a length of rebar, a paint roller extension — that distance is measured from the tip of the object, not from the person.

Plan the Encroachment Out of the Job, Not Around It

The single most valuable habit you can build is looking up during the site walk, before the bid goes out. Stand where the equipment will set up and where materials will be staged, and ask what happens if a boom swings, a ladder slips, or a truck bed goes up. Note the lines on the estimate. If clearance is genuinely tight, you have three real options and you should price them: schedule a utility shutdown, request insulating line covers from the utility, or reposition the work so the hazard is out of reach. Utilities in most states will install temporary line hose or blankets on request, often at no charge, but they need lead time measured in days or weeks. That call is free to make and impossible to make the morning of.

When avoidance is not possible and a crane will operate near lines, 1926.1408(g) requires a dedicated spotter whose only job is watching clearance, in continuous voice contact with the operator and equipped to signal a stop. It also calls for warning measures — elevated warning lines, flags, or a range control device that limits boom travel — plus a planning meeting with the operator and crew before work starts. That meeting is your documentation. Five minutes and a note in the daily log satisfies it.

The Everyday Equipment That Kills People

Cranes get the regulatory attention, but the fatality reports are full of ladders and dump beds. Fiberglass ladders belong on any job near a service drop, and aluminum ladders should not be on the truck at all if your work is exterior residential. Dump truck operators need a hard rule about confirming overhead clearance before raising the bed and lowering it before moving. Scaffold erection near a service drop requires the same ten-foot analysis, and the competent person under 1926.451 owns that call.

Tree work carries its own trap: a limb in contact with a line is energized, and so is the water in a wet rope. Unless your people are qualified line-clearance arborists under 1910.269 or 1910.331 through 1910.335, treat anything within ten feet of a conductor as somebody else's job and call the utility.

Training That Survives a Citation

Under 1926.21(b)(2) you must instruct each employee in recognizing and avoiding the unsafe conditions applicable to their work. For power line exposure, that means your people can state the ten-foot rule, know that contact with equipment while standing on the ground can be fatal through step and touch potential, and know the response if equipment does contact a line: stay in the cab, warn everyone to stay back, and if you must exit because of fire, jump clear with feet together and shuffle away without touching the machine and ground at once.

Write that down on one page, cover it in a toolbox talk, and have people sign it. Then look up on the next site walk. The regulation is asking for planning, a distance, and a spotter — and all three of those are cheaper than the alternative.
